General Terms and Conditions (T&C)

§ 1 Scope of Application

These General Terms and Conditions apply to the use of the HoliCrew platform (available at holicrew.com), operated by Christian Hofstadler, Hohe Str. 34/3, 4040 Linz, Austria (hereinafter "Operator").

§ 2 Description of Services

HoliCrew is a free platform that enables families to find other families vacationing at the same hotel. The platform offers the ability to create family profiles, register trips, and connect and exchange with other families.

§ 3 Registration and User Account

  • Use of the platform requires registration with a valid e-mail address.
  • Users must be at least 18 years old.
  • Registration data must be provided truthfully.
  • Each user may only create one account.
  • The user is responsible for keeping their login credentials confidential.

§ 4 User Obligations

The user undertakes to:

  • Not publish any unlawful, offensive, or discriminatory content
  • Not provide false information about themselves or their family
  • Not misuse the platform for commercial purposes
  • Respect the privacy of other users
  • Bear sole supervisory duty and responsibility for their own children at meetings

§ 5 Children's Data

The user declares that they have parental authority and are authorized to enter their children's data. Children's data is used exclusively for the purpose of family matchmaking on the platform and is not shared with third parties.

§ 6 Limitation of Liability

  • The operator is not liable for the accuracy of data entered by users.
  • The operator is not liable for damages arising from meetings between users.
  • The operator assumes no supervisory duty for children.
  • The operator's liability is limited to intent and gross negligence.
  • The operator is not liable for the availability or functionality of the platform.

§ 7 Termination and Account Deletion

The user may delete their account at any time via the settings. The operator reserves the right to block or delete user accounts without prior notice in the event of a breach of these Terms.

§ 8 Changes to the Terms

The operator reserves the right to amend these Terms at any time. Users will be informed of material changes by e-mail. Continued use of the platform after the Terms have been changed constitutes acceptance of the new terms.

§ 9 Applicable Law and Jurisdiction

Austrian law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Linz, Upper Austria. For consumers within the meaning of the Austrian Consumer Protection Act (KSchG), the mandatory consumer protection provisions of the state in which they have their habitual residence apply.
